Yevgeny Roizman was allowed to walk and talk

The Verkh-Isetsky District Court of Yekaterinburg chose a measure of restraint for Yevgeny Roizman, accused of discrediting the army, forbidding him to perform certain actions. The politician, in particular, will not be able to use the telephone and the Internet, as well as write letters and send telegrams. The requirement of the investigation to forbid the accused to leave the dwelling for more than one minute a day was rejected by the judge. Roizman, who was defended by many well-known musicians and writers, was released in the courtroom.
On Thursday, Judge Oksana Mamontova considered a petition from the investigation to select a measure of restraint for the former head of Yekaterinburg, Yevgeny Roizman, in respect of whom excited a criminal case on discrediting the armed forces of the Russian Federation (part 1 of article 280.3 of the Criminal Code of the Russian Federation). According to the investigation, Mr. Roizman committed illegal actions by posting the video “Answers to your questions” on YouTube on July 1, where he shared his negative opinion about the Russian military special operation in Ukraine. Previously, he had already three times was fined according to part 1 of Art. 20.3.3 of the Code of Administrative Offenses of the Russian Federation (discrediting the armed forces of the Russian Federation), court decisions have come into force. The day before, Yevgeny Roizman was detained, searches were carried out in his home, the Museum of the Nevyansk Icon and the Roizman Foundation.
The representative of the Moscow investigative group petitioned for the election of a preventive measure for Mr. Roizman in the form of a ban on certain actions.
Thus, the investigation demanded until September 29 to prohibit him from leaving his home from 0:00 to 23:59, attending public places and events, using the telephone and the Internet (except for communicating with a lawyer and investigators), and communicating without the written permission of the investigator with any persons. The prosecutor, considering that the accused could continue to engage in criminal activity, supported the petition.
By the way, even Judge Mamontova was surprised at the only minute of “freedom” per day. Yevgeny Roizman from behind bars expressed his opinion on the petition of the investigation: “Your honor, I am frankly against it. Even in the pre-trial detention center, I had more rights and opportunities.” He also noted that the list of restrictions, which the prosecution insists on, will become an obstacle to the effective work of the Roizman Foundation. This charitable structure specifically helps people in difficult life situations. According to the website, the Roizman Foundation is the largest organization in the Urals, which exists only on private donations from supporters from all over the world. “About 500 families are closed to the fund – the poor, with various problems. At least a hundred calls a week come from everywhere. A large part of the reception of these appeals is social networks. A lot is closed to me – in particular, weekly receptions, which are attended by up to a hundred people, where there are often questions of life and death. And to take me and delete me from this activity is simply dishonest in relation to those people whom I help, ”explained Mr. Roizman.
At the request of the lawyer, positive references were attached to Yevgeny Roizman from famous musicians and writers. “Dmitry Bykov (included in the register of foreign media agents.— “b”) characterizes Yevgeny Roizman as a true patriot of his city, points to his merits. Yuri Shevchuk appealed to the judiciary with a positive reference, with a similar one – Boris Grebenshchikov, Andrey Makarevich, Boris Akunin, ”Judge Mamontova listed. Nobel laureate, editor-in-chief of Novaya Gazeta Dmitry Muratov wrote in an address: “I have known E. V. Roizman for 30 years as an outstanding poet, and 15 personally. He is what they say is a humanist. It was Evgeny who was one of those who several times managed to organize a fundraiser for children with SMA. He saved people from incurable diseases, and icons from unscrupulous hands and money. Roizman loves and respects one of the fundamental cities of our country. He is always a support for those who need help.
After two hours in the deliberation room, judge Oksana Mamontova partially granted the petition of the investigation and the prosecutor’s office.
According to the court decision, Yevgeny Roizman is forbidden to attend public places and events; communicate without the written permission of the investigator with witnesses in a criminal case (with the exception of the family living with him in the apartment); send and receive letters and telegrams (with the exception of those relevant to the case); use any means of communication (with the exception of cases of communication with a lawyer, investigator, prosecutor, court or calling an ambulance or emergency service). In addition, the accused was under an obligation to appear at the request of the investigation. The demand to prohibit the ex-mayor of Yekaterinburg from leaving his home from 0:00 to 23:59 Judge Mamontova rejected and decided to release Mr. Roizman from custody immediately in the courtroom.
According to Vladislav Idamzhapov, the defendant’s lawyer, it is impossible to consider the decision on Mr. Roizman’s measure of restraint as inhumane: “You can walk, you can talk, which means that some constitutional guarantees have been observed.” Whether the decision of Judge Mamontova will be appealed will become clear after its careful study, the lawyer added. By law, this is three days. Mr. Idamzhapov refused to talk about the prospects for the investigation and the future trial.
