The State Duma suggested that the state pay alimony for mobilized

Margarita Simonyan stated that she had taken the lists of “alimony workers” from the Sochi bailiffs and gave them to the military registration and enlistment office. According to her, now “alimony workers will repay their debt not only to their children, but also to the Motherland.” And in the State Duma they proposed to leave the belligerents alimony in peace: instead of them, the state should pay.

“MK” has already written that now some women voluntarily hand over to the authorities the places of residence of ex-believers to hand them subpoenas in the hope of receiving money due for children from large military allowances.

According to various sources, from 1.5 to 2 million people live in Russia who are required to pay alimony. Here, of course, not only men, but also women, and those deprived of parental rights, as well as those who abandoned their parental responsibilities. The number is impressive.

According to the statistics of the bailiff service, in the first half of 2019, the department had 1.2 million court decisions on the recovery of alimony from debtors in the amount of 167 billion rubles. So, in 2019, the average amount of alimony debt was 142 thousand rubles. And even the introduction of an article on persistent non-payers into the Criminal Code did not help.

Most debtors are men. They make up 78%, and in Moscow all 90%.

Very often, bailiffs simply shrug their shoulders – they say, we cannot find your debtor, we are not omnipotent. Therefore, ex-wives are happy to provide all the data on their husbands to the military registration and enlistment offices, in the hope that the warriors have a much greater interest in the search for “alimony dodgers.” They promise to help.

So it is. However, unfortunately, the bailiffs are not as optimistic as the military commissars and Margarita Simonyan. She is a married woman and, probably, simply does not know all these subtleties of knocking out alimony debts. Lawyers believe that it is impossible to recover at least something while the debtor participates in the SVO in Ukraine.

There are specific legal loopholes through which negligent fathers can legally get away from their direct parental financial responsibilities. The fact is that as soon as the alimony is taken to the SVO, the bailiffs stop the proceedings against him. Since a decision has already been made on credit holidays in relation to all debts. What about the mortgage, what about the children. In this regard, debts to their bloodlines are no better than debts to banks.

According to the media in the press service of the department of bailiffs, if a citizen who was mobilized has open enforcement proceedings for all types of debts – from alimony to unpaid loans, then he can apply for their suspension for the period of service.

Of course, sooner or later, he will have to pay – but first he must return home alive.

“Mobilized people need to submit an application as soon as possible in order to exclude the write-off of funds and blocking of accounts. This can be done right at the recruiting office in the military registration and enlistment office or personally go to the bailiffs department, you can also send an application by e-mail to the GUFSSP of Russia in your region, ”the lawyers say.

If the mobilized did not have time to submit such an application, the next of kin can do it for him, for example, a new wife, who, of course, has her own interests in this matter.

In theory, 25% for one child and 50% for two or more should also be deducted from the military allowance every month. It’s the same salary. However, judging by what is happening, so far there are many discrepancies in this issue.

“Mobilized citizens are not exempted from the obligation to pay alimony. They are listed in the same order. The amount of alimony may change along with the change in the income of the mobilized person who will receive payments under the contract. Thus, military personnel will receive monetary allowances paid by the settlement center of the Ministry of Defense. Documents on the obligation to pay alimony must be sent there,” lawyer Andrey Mikhailov commented to us.

Ideally so. How about in practice? But in practice, in the State Duma, for example, they proposed another way out of the situation so that no one would be offended and the malicious alimony people would calmly fight, the state should pay alimony instead of them. And not only for debtors, but in general for all alimony.

This bill was submitted today to the State Duma. In the event of the death of a serviceman, the deputies also propose the full repayment of his debt to his children.

It is also proposed to pay off alimony arrears in the event that a mobilized person is diagnosed with a disease obtained during the performance of tasks during a special operation. “The introduction of such a norm will allow to preserve the previous standard of living for children as much as possible,” the deputies are sure.

In this case, it is not very clear what amount is supposed to be considered basic in order to pay alimony from it? The minimum wage, which is the average for Russia, or the salary with which the father left for the SVO?

The spread will turn out to be considerable – some salaries can amount to hundreds of thousands per month, and our minimum wage is standard and currently equals 13,800. That is, 25% of it is less than 3.5 thousand rubles.

A member of the State Duma Committee on Social Policy, Ekaterina Stenyakina, called the idea unreasonable for another reason: the mobilized quite officially receive a monetary allowance in the amount of 195 thousand rubles a month. So is it really impossible to pay for the maintenance of your own children with this quite decent amount?
