The State Duma in the first reading approved the release of contract workers from criminal punishment

The State Duma adopted in the first reading a draft aimed at enshrining in legislation a mechanism for exempting persons who have entered into a contract for military service from criminal liability. The term will be replaced by a conditional one.
The draft law was introduced to the State Duma on March 6. The initiative was prepared by deputies Pavel Krasheninnikov and Andrei Kartapolov (both from United Russia), as well as senator Andrei Klishas. “The draft more clearly articulates the principle of voluntariness for such persons to join the ranks of the RF Armed Forces,” commented Pavel Krasheninnikov (quoted from a press release ).
The initiative makes it possible to conclude a contract with the Ministry of Defense who is under investigation, on trial, or who has already been sentenced for crimes of light and medium gravity. Crimes against the sexual integrity of minors, as well as terrorism, against the foundations of the constitutional order and state security are not covered by the bill. If a contract is concluded with the Ministry of Defense, the cases of the suspects will be suspended, and the real term of imprisonment will be replaced with a suspended one. The leadership of military units will control the behavior of such contract soldiers. In case of a repeated crime, the court will impose a punishment taking into account the previous one.
Exemption from liability and expungement of a criminal record will be possible if the contract soldier receives a state award or retires from service on certain grounds specified in the Federal Law “On Military Duty and Military Service.” The author of the initiative emphasizes that convicted persons are not exempt from the obligation to compensate harm to victims. “If the criminal case is terminated due to the dismissal of such persons from the RF Armed Forces, the civil case will not be terminated,” the deputy emphasized.
