The court partially satisfied the claim of the deputy chairman of the Spiritual Administration of Muslims of Bashkiria (DUM RB) for development Zimfir Gabdrakipov against the employer and recovered about 2.1 million rubles from the organization. wage arrears and compensation for delayed payment. The DUM insisted that Mr. Gabdrakipov “practically did not appear” at work for three years and used the management building “exclusively for his own purposes to carry out business activities.” The plaintiff managed to prove that all this time he was looking for investors to complete the construction of the Ar-Rahim mosque.

In the Kalininsky District Court of Ufa, chaired by Alsou Sharipkulova, the consideration of the claim of the deputy chairman of the Muslim Spiritual Directorate of Bashkortostan for development, Zimfir Gabdrakipov, against the employer was completed (“Kommersant” spoke in detail about the essence of the conflict on September 5). Mr. Gabdrakipov asked the court to recover wage arrears in the amount of 1.5 million rubles. and interest for delay in payment from October 2020 to June of this year – 568 thousand rubles.

The defendant insisted that Zimfir Gabdrakipov “practically did not appear” in the building of the Muslim Spiritual Directorate of the Republic of Belarus for three years. In April 2020, he, “having the opportunity to influence” the work of the spiritual administration, registered LLC “Centralized Accounting Department of the Spiritual Administration of Muslims of Bashkiria”, to which personnel issues of the Spiritual Administration of the Republic of Belarus and the maintenance of its accounting were transferred. In addition, at the legal address of the management, the plaintiff, noted in the Spiritual Directorate of Management of the Republic of Belarus, registered the Vatan charitable foundation. Based on this, the Spiritual Directorate of Management of the Republic of Belarus emphasizes, Mr. Gabdrakipov used the management building “exclusively for his own purposes to carry out business activities.”

As Zimfir Gabdrakipov explained in court, he was hired unofficially by the Muslim Spiritual Directorate of the Republic of Belarus in 2019, and in 2020 an employment contract was concluded with him. The monthly salary, he said, was 48 thousand rubles. Speaking about his official duties, Mr. Gabdrakipov said that his functionality, in particular, was to find investors to finance the completion of the Ar-Rakhim Cathedral Mosque in Ufa (the mosque has been under construction since 2007, the degree of completion is about 40%).

“So today you are looking for investors?” – the judge asked. The plaintiff confirmed. “But there are no developers in Ufa,” said Olga Isyanmanova, a representative of the defendant. The head of the Muslim Spiritual Directorate of the Republic of Belarus, Ainur Birgalin, who was present at the trial, said that he organized a joint business trip to Turkey. The judge asked why he took the plaintiff on a business trip. “At that time he was a person close to my soul,” answered the mufti.

Zimfir Gabdrakipov said that his work boiled down, in particular, to discussing the conditions for the completion of the cathedral mosque, and some potential investors were “rejected” by the Spiritual Directorate of Muslims of the Republic of Belarus. Then Ainur Birgalin asked to remember the name of at least one company, thanks to which the mosque could be completed. “Yes, the agreement signed with Sberbank for 5 billion rubles a month ago. for co-investment in the construction of a mosque, development of the territory.”— “Zimfir, what do you have to do with this? I drew up this agreement myself, worked it out myself. We called Sberbank almost every day. We’ve been working on (options) for a year now!” — the head of the Muslim Spiritual Directorate of the Republic of Belarus was indignant.

Olga Isyanamanova asked the judge to refuse to satisfy the claims, explaining that the plaintiff had not proven to the court that he had performed any work at the Spiritual Directorate of the Spiritual Directorate of the Republic of Belarus. She added that the statute of limitations had expired.

Alsou Sharipkulova decided to partially satisfy the claim: she established the fact of labor relations between the plaintiff and the Muslim Spiritual Directorate of the Republic of Belarus and recovered from the Spiritual Administration the salary debt for the period from June 2021 to October 2023 of about 1.4 million rubles. and compensation for the delay in payment in the amount of 710 thousand rubles. She refused to satisfy the demands for recovery of wages from September 2020 to May 2021 and compensation. The motivational part of the decision will be ready later.

The representative of the Spiritual Administration of the Republic of Belarus in court, Ilshat Garifullin, told Kommersant that the spiritual administration will file an appeal against the decision of the district court.
