The Ministry of Health has determined how and when an independent medical examination should be carried out

With its help, citizens will be able to prove their professional suitability

The Russian Ministry of Health decided to consolidate the right of a citizen to prove his professional suitability with the help of independent medical experts. Project government regulationswhich must approve the “Regulations on Independent Medical Expertise”, has been submitted for public discussion on the portal of draft regulatory legal acts.

The right to turn to independent medical experts is guaranteed by the law “On the Fundamentals of Protecting the Health of Citizens in the Russian Federation”, but until now the procedure for conducting such examinations has not been regulated.

The document developed by the Ministry of Health states that an examination should be carried out at the request of a citizen or his legal representative in case of disagreement with a medical report on his suitability or unsuitability to perform certain types of work. Such a conclusion must be drawn up on the basis of the protocol of the medical commission that conducted an examination of the person’s professional suitability at his place of work. The citizen presents it to independent experts.

The examination must begin no later than three days after submission of the application. Then, within 10 days, doctors get acquainted with the documents presented to them and, if necessary, prescribe additional studies and tests. The decision of the expert commission is documented in a protocol.

Experts can make three verdicts: professionally suitable, unsuitable or temporarily unsuitable. In all three cases, specialists must indicate on what basis their decision is based, and in the latter case, also indicate what needs to be done (or what should be avoided) by the examinee in order to restore professional fitness. In case of prescribing additional treatment or additional studies, the period for preparing the protocol may be increased, but not more than up to 30 days.

Based on the protocol, a conclusion is prepared in two copies. One is given to the person examined, the other is kept in an expert organization for 50 years.
