The government did not support the project to expel migrants for harassing people

The Russian Government Commission on Legislative Activities did not support the bill introducing fines of up to 5 thousand rubles. with expulsion for migrants who harass citizens. The commission considered that the initiative did not take into account the liability for petty hooliganism already established by the Code of Administrative Offenses, and the explanatory note does not contain data that would indicate the ineffectiveness of the current legislation.

The draft law was developed by State Duma Vice Speaker Vladislav Davankov (“New People”). He proposed adding a new provision to Art. 20.1 (petty hooliganism) of the Administrative Code. For migrants and stateless persons, a fine of 4 thousand to 5 thousand rubles would be provided. with expulsion from the country for offensive harassment of citizens.

The government recalled the position of the Constitutional Court, which ruled that courts, when considering cases of violation of the stay regime by foreigners leading to expulsion, should be able to take into account circumstances that “allow them to properly assess the proportionality of its consequences to the goals of introducing this measure of administrative liability.” “The government of the Russian Federation does not support the bill,” says the draft review (quoted by TASS).

Mr. Davankov said that the faction will defend this bill. “This is a matter of people’s safety, so we will defend our bill. We will study the government’s response and discuss further steps at a faction meeting,” the politician emphasized.
