If the tree is not located on the territory of the fenced area, then it is considered that it belongs to the municipality or is in common use, said State Duma deputy, chairman of the Union of Summer Residents of the Moscow Region Nikita Chaplin.
He noted that in such a situation, anyone can use the fruits of the tree, and any claims from the person who planted such a tree are groundless.
“Even if you yourself planted cherries or raspberries behind the fence, then by law anyone can pick berries from the trees, since this is no longer your land,” he said.
At the same time, the summer resident is obliged to monitor the condition of the territory adjacent to his site, for example, for the presence of harmful plants on it, for example, hogweed. Chaplin also noted that a summer resident can seek to cut down a neighbor’s tree if it obscures his site.
