It is possible to re-register an abandoned garden plot of a neighbor by following a number of procedures, said Nikita Chaplin, chairman of the Union of Summer Residents of the Moscow Region and State Duma deputy, in an interview with RIA Novosti.

He noted that in the first case, re-registration is possible if the site has been abandoned for more than three years or is used in violation of the permitted purpose of the land. In such a situation, the plot changes ownership by court order, and is usually transferred to the municipality.

In the event that the owner renounced the rights to the land, or it was left without an owner (for example, after the death of the owner, when no one entered into the inheritance), then Rosreestr can register land with such a status. But this also does not guarantee a quick re-issuance.

The best option is if the summer resident takes care of an ownerless land or house, and their owners do not appear and do not claim their rights for 15 years. In this case, acquisitive prescription comes into force, and the person who looked after the house or plot can become the full owner.

At the same time, the deputy noted, in some regions their own norms and programs can be established, about a year ago the government of the Russian Federation approved a list of cases for transferring plots to citizens on preferential terms.
