The Constitutional Court recognized as legal the annulment of residence permits of supporters of extremism

The Constitutional Court (CC) has established that authorized bodies can legally take away residence permits from citizens who are considered by state security agencies to be supporters of terrorist and extremist activities. The Constitutional Court refused to consider the complaint of Anna Vasilyeva, a citizen of Ukraine. The Ministry of Internal Affairs deprived her of her residence permit in Russia due to information received from the FSB that she poses a threat to the security of the state – she supports terrorist and extremist activities.

First, Anna Vasilyeva challenged the decision of the Ministry of Internal Affairs in lower instances, which recognized the punishment as justified. After that, she challenged the constitutionality of subparagraph 2 of paragraph 1 of Art. 9 of the Federal Law “On the legal status of foreign citizens in the Russian Federation”, which establishes the grounds for the cancellation of a residence permit.

The Constitutional Court noted that one of the grounds for depriving a foreigner of a residence permit is the financing, planning and commission of terrorist or extremist acts or supporting such activities by “other actions”.

The decision of the Constitutional Court states that when determining punishment, the legislator “is bound by the constitutional principle of proportionality and the requirements arising from it of the adequacy and proportionality of the legal means used.” It also notes that the legislator accepts not excessive, but necessary restrictions, due to “constitutionally recognized goals.”

The Constitutional Court considered that Anna Vasilyeva should have challenged the decision of the FSB, which recognized her as supporting terrorist and extremist activities. Thus, he recognized the lawful deprivation of foreigners’ residence permits in such cases.
