State Duma deputies proposed to abolish 25 articles of the Russian Code of Administrative Offenses (CAO). Thus, they intend to “reduce administrative pressure on citizens and business entities.” The relevant bill has been sent to receive an official response from the government, said Vedomosti Aleksey Nechaev, leader of the New People faction in the State Duma and co-author of the amendments.
The publication notes that the main block of amendments is associated with the abolition of “duplicate” norms of the code, according to which entrepreneurs can be fined. The deputies also propose to abolish several articles relating to labor relations at once. The deputies also drew attention to the outdated norms of the code, in particular Art. 14.15.2 and 14.15.3 of the Code of Administrative Offenses. They involve fines for the illegal sale of tickets for matches of the European Football Championship 2020.
The deputies consider the abolition of Art. 20.6.1 of the Code of Administrative Offenses (failure to comply with the rules of conduct when introducing a high alert mode). “During the covid, a huge number of individual entrepreneurs and legal entities were attracted through it. Employees were often punished for not wearing a mask: cashiers, shop assistants. The fines hit hard on the pockets of entrepreneurs: their amount for individual entrepreneurs is from 30 thousand to 50 thousand rubles, for legal entities – from 100 thousand to 300 thousand rubles, ”explained Alexey Nechaev.
The explanatory materials to the bill indicate that during the period of the coronavirus restrictions under Art. 20.6.1 of the Code of Administrative Offenses, more than 1 million individual entrepreneurs and companies were held liable. Rospotrebnadzor announced the removal of restrictions related to COVID-19 in the summer of 2022. “Covid has passed, but the convenient wording “high alert” has remained in the Code of Administrative Offenses,” Mr. Nechaev noted.
The current Code of Administrative Offenses of the Russian Federation was adopted by the State Duma on December 20, 2001 and subsequently changed several times. The development of a new Code of Administrative Offenses has been going on for several years. The Ministry of Justice presented several projects. However, many of the provisions have been criticized. In January 2023, the department stated, which continues to work on new codes. This is done by an interdepartmental working group with the participation of representatives of more than 100 state bodies and organizations.
