Andrey Klishas, ​​head of the Federation Council committee on constitutional legislation and state building, wrote in Telegramthat “raids” on Russians, allegedly evading mobilization, are illegal. He explained that it is already impossible to “catch” people on the street and find out if they fall under mobilization at the military registration and enlistment office itself, since the subpoenas are handed out to specific individuals.

Mr. Klishas provided the following explanation:

  • Police officers have the right to deliver to the military registration and enlistment office only a specific conscript (or a person subject to mobilization) for whom there is a written request from the military registration and enlistment office.
  • Call work is targeted. Military commissars call for a specific conscript, subpoenas are handed to a specific person, materials are transferred to law enforcement agencies in relation to a specific draft dodger. The military commissars do not have the right to act in relation to an indefinite circle of persons.
  • The internal affairs bodies are connected to the issues of conscription for military service only in the event of a written request from the military registration and enlistment office for the delivery of a specific person or during the search for draft dodgers.
  • Police officers have the right to hand over a referral to the military registration and enlistment office for military registration to persons who are not registered with the military, but are obliged to be on it. It seems redundant to use this tool for citizens who are in reserve, the senator believes.
  • Summons are handed to citizens by employees of the military commissariat at the place of work or study. It was the employees of the military commissariat, not the police and not the traffic police when checking documents, Mr. Klishas emphasized.

“You can’t indiscriminately grab everyone on the street, and then sort it out at the military registration and enlistment office whether a citizen meets the criteria for mobilization. And even more so, it is unacceptable to sort it out after sending a citizen to a collection point, ”Andrei Klishas noted.
