The Supreme Court of Russia gave the right to the employer to dismiss employees in a state of intoxication without a medical examination. This became known from the case file on the restoration of a defense plant locksmith after being fired for drunkenness at work.
“The state of alcoholic or narcotic or other toxic intoxication can be confirmed both by a medical report and other types of evidence …”, the Supreme Court said.
From the material on the website of the court it follows that the locksmith of the St. Petersburg plant “Red October” came to work in a state of intoxication. He wrote an explanatory note with an apology, but the examination did not pass.
The management of the plant fired the man, but he filed a lawsuit, after which the worker was reinstated, since there were no objective signs of intoxication.
Later, the Supreme Court reversed this decision, stating that it was necessary to take into account all factors that could refute the worker’s sobriety. The case was sent to the court of first instance for retrial.
