The deputy of the Samara provincial Duma from the Communist Party of the Russian Federation Mikhail Abdalkin was fined 150 thousand rubles on Thursday. for listening to the president’s address to the Federal Assembly with noodles on his ears. The police considered that he had discredited the “execution by the state bodies of the Russian Federation of their powers outside the Russian Federation,” and he did this as an official in the office of the parliament. The communist insists that he did not discredit anyone, but only expressed dissatisfaction with the economic situation in the country.
On March 16, the city court of Novokuybyshevsk, following the results of consideration of the administrative protocol on public actions to discredit the Russian Armed Forces (part 1 of article 20.3.3 of the Code of Administrative Offenses), decided to fine Mikhail Abdalkin for 150 thousand rubles. As stated in the court documents, which Kommersant got acquainted with, the deputy was found guilty of listening to the president’s message with noodles on his ears, nodding his head and “by his public actions discredited the exercise by state bodies of the Russian Federation of their powers outside the Russian Federation in order to protect the interests of the Russian Federation and its borders, maintaining international peace and security, ”and also that he later posted a video of this on the Internet.
Recall that with noodles on his ears, the communist listened to a fragment of the message, during which Vladimir Putin spoke about the “long centuries of colonialism, diktat, hegemony” of the United States and NATO, accustomed to “spitting on the whole world”, as well as about the “cynical deception” associated with “ fables about the search for peace, about adherence to the resolutions of the UN Security Council on Donbass.” The video of the deputy on VKontakte was accompanied by a sarcastic comment: “I fully support, I fully agree, excellent performance. I have not heard anything like this in the last 23 years. Pleasantly surprised”.
At the court session, the parliamentarian explained that he pursued a different goal with his act: “I believe that I did not insult the Armed Forces. On the contrary, we help drafted servicemen. I expressed my dissatisfaction. It was due to the fact that for the ninth year incomes have been falling and the population is impoverished. This is the general opinion of those people who come to me, voted for me and are dissatisfied with the economic situation.” The deputy’s defense drew attention to violations in the protocol and the lack of information about the administrative investigation.
“In the protocol, he was not charged with discrediting the Russian Armed Forces. He was accused of discrediting the exercise by Russian state bodies of their powers outside the Russian Federation,” the communist’s lawyer Alexei Lapuzin told Kommersant. If this is Mr. Putin, the President of the Russian Federation, then it is obvious that he was in Moscow at the time of the announcement of his message. But it is not clear from the protocol. We pointed out to the court the obvious vagueness of the document.”
It should be noted that Mikhail Abdalkin was fined as an official, since the video was recorded in his office in the Samara Provincial Duma. He himself did not dispute this. Art. 20.3.3 part 1 of the Code of Administrative Offenses provides for a fine from 30 thousand to 50 thousand rubles for individuals, and from 100 thousand to 200 thousand rubles for officials.
In the Samara regional committee of the Communist Party, it was essentially difficult to comment on the punishment of Comrade Abdalkin.
“We will first wait for the court’s decision, read what is written there and why we came to this conclusion,” said Alexei Leskin, the first secretary of the regional committee, vice speaker of the provincial duma, to Kommersant.
The press secretary of the chairman of the Central Committee of the Communist Party of the Russian Federation Gennady Zyuganov, Alexander Yushchenko, did not answer the call of Kommersant.
Recall that immediately after the appearance of the video, the Samara Provincial Duma expressed “public censure” to Mikhail Abdalkin and recommended the Communist Party of the Russian Federation to expel him from the party. He was severely criticized even by his comrades in the regional committee. The leadership of the Communist Party stood up for the deputy, saying that the Samara communists themselves would decide how to punish him, and if the regional committee did not take action, the situation would be considered at the federal level. As Aleksey Leskin told Kommersant, the case of deputy Abdalkin will be considered at a scheduled meeting of the regional committee bureau, which will be held before the end of March. He did not anticipate possible sanctions against his comrade. “The meeting has not yet taken place. The most important thing here is not to rush. It is necessary to get away from emotions in politics, in general it is very harmful to show emotions,” concluded Mr. Leskin.
