FAS issued an order to Apple due to the imposition of unfavorable conditions on iOS developers

The Federal Antimonopoly Service issued Apple Inc. an order within 60 days to stop violating the law on the protection of competition, which manifested itself in the imposition of unfavorable contract terms on application developers, informed “Interfax” with reference to the materials of the Federal Antimonopoly Service.
The department explained that Apple imposed unfavorable contract terms on developers, and also forced them to degrade the functionality of applications. The FAS explained that there is a condition in the Apple manual according to which developers are actually prohibited from inducing application users to pay for purchases outside of the application itself. For example, the developer of the application “LitRes: Read and Listen Online” has no right to indicate on the purchase page a notice that the book can be purchased on the site.
The FAS concluded that such a ban makes it difficult for developers to sell goods to Apple technology users outside of iOS applications. This creates unfavorable conditions for developers, because of which there may be a restriction on the circulation of goods on the market.
“Since the guidelines are mandatory for all developers of iOS applications, failure to comply with them in part or in full will result in Apple not allowing the iOS application to the App Store, the presence of the above prohibition indicates the imposition by Apple of unfavorable terms of the contract in relation to developers ”, the FAS emphasized.
The agency ordered Apple to remove from the guidance a ban on inducing app users to purchase outside of the app and stop requiring developers to degrade app functionality.
In July, the agency found Apple guilty of abusing its dominant position in the iOS app distribution market. The company faces a turnover fine, the amount of which will be determined in the course of an administrative investigation. According to the legislation, it can be 0.01-0.15% of the company’s annual revenue in Russia.
