Fans filed a strange lawsuit against Madonna: “I had to get up early”

Fans of the singer experienced frustration

Singer Madonna was sued by fans because of the late start of the concert, after which fans of the pop star “had to get up early” the next morning.

The lawsuit, filed Wednesday, seeks class-action status for all of Madonna’s other Celebration tour U.S. concerts that started late.

According to The Guardian, two Madonna fans in New York are suing the pop star for the late start of her concert, claiming they “had to get up early to go to work” the next morning.

In the lawsuit filed Wednesday in federal court in Brooklyn, Michael Fellows and Jonathan Hadden claim they bought tickets to the Dec. 13 show at Barclays Center as part of Madonna’s holiday tour.

According to the lawsuit, the show was supposed to start at 8:30 p.m., but the 65-year-old star singer didn’t take the stage until after 10:30 p.m.

By the time the two concertgoers left after 1 a.m., they “found themselves stranded in the middle of the night” and “faced with limited public transportation, limited rideshare seating, and/or increased costs of public and private transportation.”

The show’s late finish on a weeknight also impacted their ability to “take care of their family responsibilities the next day,” the suit alleges.

As The Guardian notes, Michael Fellows and Jonathan Hadden are accusing Madonna, the Barclays Center and tour promoter Live Nation of “unfair, unfair and/or deceptive trade practices” for the delayed start, which the couple say constitutes a breach of contract and “the wanton use of false advertising.”

The lawsuit seeks class-action status for participants in other holiday shows that started late, including Madonna’s next two concerts in New York on Dec. 14 and 16.

Delays in performances are not uncommon in the world of live music, The Guardian emphasizes. Madonna herself has faced similar lawsuits before: in 2019, when a Florida fan claimed her lateness to the Madame X tour was a breach of contract; and again in 2020, in a lawsuit brought by two New York City concertgoers.

Both claims were later voluntarily dismissed, The Guardian recalls.

Madonna’s current holiday tour was postponed from last July after the singer was hospitalized with a bacterial infection. The tour continues until its final stop in Mexico in April.
