Doctors received a manual on how to respond to boorish behavior of patients

The boorish attitude of patients towards doctors in Russia is a very common phenomenon. Instead of gratitude for their help, doctors and nurses often receive rich portions of insults from their patients, often expressed in obscene form.
It’s not that the patience of the people in white coats has reached a limit, but the lawyers have firmly decided to recommend that they not let the situation go on the brakes and not allow themselves to be offended. Together with philologists, lawyers from the country’s largest association of doctors – the National Medical Chamber – analyzed judicial practice and compiled a detailed manual on how to act if someone calls you names.
The Code of Administrative Offenses of the Russian Federation contains Article 5.61 – “Insult, disparagement of honor and dignity, expressed in indecent form.” The article provides for punishment in the form of an administrative fine of up to 5 thousand rubles. And, judging by the rich judicial practice, these fines often find their heroes.
For example, last year the Magistrate Court of the city of Kursk fined a citizen 3 thousand rubles for a whole bunch of insults towards a doctor. Here are the most decent of them: “nonsense”, “you are a fabulous idiot”, “the loser is you, one hundred percent henpecked, not a man!”, “the brainless woodpecker is you!” A resident of the Saratov region was given a similar punishment for being a “one-eyed goat” and a “schmuck,” and calling doctors names for residents of other regions cost the same amount. A resident of Lipetsk has already been fined 4 thousand rubles for being a “stupid sheep”. And the highest fine (6 thousand) was received last year by a resident of the Kaluga region for obscene insult.
Lawyers consider the situation to be overflowing and strongly recommend that doctors hold the boorish people accountable. “Insult is a type of mental violence, which is expressed in a negative assessment by the perpetrator of the citizen’s personality, undermines the latter’s reputation in the eyes of others and damages his self-esteem. Insult can be expressed orally, for example, in the form of curses, or in writing in the form of notes or letters addressed to the citizen. Also, insult can be expressed in physical actions (for example, spitting, slapping),” they explain in the manual compiled for workers in white coats.
Experts note that the main thematic groups of swear words include: names of animals; names of sewage; appeals to evil spirits; accusations of illegitimacy; names of intimate relationships and names of genitals. And they recommend that health workers act immediately if they receive insults.
As Lilia Aidarova, head of the legal service of the National Medical Chamber, told MK, there was no special reason to draw up such a manual for doctors – the accumulation effect simply worked:
— Boorish statements have become common not only in relation to doctors. Statements of an offensive nature today take place in the sphere of receiving any help and any services. Probably the main reason is the cultural and educational level of the population. But we protect the interests of healthcare workers. Therefore, we first analyzed judicial acts and, in general, the vicious practice of treating patients with medical workers. We studied court decisions that were made under Article 5.61 of the Code of Administrative Offences. And then they drew up a very detailed algorithm of actions – what a health worker should do if offensive statements were made towards him. In short, he needs to contact the prosecutor’s office with a statement and attach evidence to it. What is the evidence? This could be witness testimony, telephone or voice recordings, SMS, statements on social networks. In the manual we provide an assessment of which words and expressions are offensive. Sometimes these are quite literary words, but the context is taken into account: if they are pronounced or written with the intent to humiliate or insult, we can talk about the elements of an offense.
— The fine for such offenses is quite small…
— Yes, up to 5 thousand rubles, but the courts most often assign the “middle price”. And yet the main goal is not so much to punish as to stop the crime. This punishment also entails preventive measures so that this does not happen again in the future. And it is not the size of the fine that is important, it is important to show that this is a punishable act and that by insulting a doctor, a person is recognized as an offender, and the state is involved in protecting the interests of the victim.
— Why do patients throw mud at medical workers most often? Or is there no particular need for a reason?
— Insulting statements can be made by patients at any time – towards an ambulance doctor, a local doctor, etc. For example, a patient thought that the doctor was working too slowly. Or that the queue is too long. Or he is simply in a bad mood – the human factor is largely at work, which results in abuse and insults. I repeat, this is not uncommon, and judicial practice is not limited to any one area or one region.
— How will you communicate the new guidelines to local doctors?
— In each subject of the Federation there is a branch of the National Medical Chamber and trade union associations of doctors, all member organizations received documents, and many posted them on regional websites. In general, our manuals should not go unnoticed among doctors. There are two training manuals – the second is devoted to the actions of doctors in situations involving the obstruction of medical care, when they are simply not allowed to work. Each has a short algorithm – where to go and what to do so that the person who violated the law is brought to justice.
— That is, they will fight against patient rudeness on a large scale?
“I would say our goal is to protect health workers who are being attacked and insulted.
