On Friday, the Soviet District Court of Ufa refused musician Yuri Shevchuk, accused of discrediting the armed forces of the Russian Federation, to send an administrative case for consideration to St. Petersburg, where the leader of the DDT group lives. At the same time, judge Yulia Egorova added to the materials the results of a psycholinguistic examination carried out at the request of the defense, from which it follows that “the controversial material of Shevchuk’s speech does not contain public appeals and negative information about the armed forces of the Russian Federation, including a negative assessment of their actions.”
In the Sovetsky District Court of Ufa, the first meeting on the administrative case against the leader of the DDT group, Yuri Shevchuk, took place. Mr. Shevchuk accuse in discrediting the armed forces of the Russian Federation (part 1 of article 20.3.3 of the Code of Administrative Offenses of the Russian Federation) after the May concert in Ufa. The DDT group at the Ufa Arena gathered about 10 thousand spectators at that time. During the three-hour concert, the phrases appeared on the screens during the group’s performance: “Don’t shoot” (this is the name of one of the most famous songs of DDT) and “No to war”. The frontman himself, in the course of communicating with the audience, said that “the Motherland is not the president’s ass to procrastinate and kiss it.” The report on the musician was drawn up by employees of the Ufa police department No. 7. The press service of the regional Ministry of Internal Affairs the next day after the concert, “Kommersant” clarified that the protocol was drawn up “in connection with the provocative statements” of the musician.
Materials on Yuri Shevchuk were received by the Sovetsky District Court of Ufa. From there, at the request of Yuri Shevchuk, the case sent Petersburg, where he lives. However, the Dzerzhinsky District Court refused to start consideration. As explained in the joint press service of the courts of St. Petersburg, “the protocol does not describe the event of the offense, there is no indication of what exactly the public calls for obstructing the use of the armed forces of the Russian Federation expressed.” Therefore, the case was returned to the Ufa police to eliminate the shortcomings.
It should be noted that earlier, answering the question of “Kommersant”, for what specific phrases he was being persecuted, Mr. Shevchuk said that he did not know: “I’m there (at the concert.— “b”) said a lot of things.
On July 15, the materials were again received by the Dzerzhinsky Court of Ufa, and on July 18 the case was sent under jurisdiction to the Soviet District Court of the city.
On Friday Yuri Shevchuk did not participate in the court session. Lawyer Alexander Peredruk, representing his interests, petitioned to transfer the case to the Dzerzhinsky District Court of St. Petersburg. Judge Yulia Yegorova rejected the request. If it is inconvenient for Mr. Shevchuk to come to Ufa, he can participate in trials via video conference, she said. Another petition of the musician’s lawyer – to adjourn the meeting – was granted by the judge. Oleksandr Peredruk asked for time to familiarize himself with the case materials, explaining that his client had not received the protocol on the basis of which he was brought to justice.
At the same time, the court attached to the case file a psycholinguistic examination conducted at the request of the defense by specialists from the Nizhny Novgorod State University, and a video recording of Yuri Shevchuk’s speech in Ufa.
“According to this conclusion, the controversial material of Shevchuk’s speech does not contain public appeals, does not contain negative information about the armed forces of the Russian Federation, including a negative assessment of their actions. And also it does not contain negative information, expressed in the form of a statement, about the facts in relation to any person, ”said the lawyer.
After the court session, Alexander Peredruk said that at the next court session he would also apply for a court request to the Constitutional Court of the Russian Federation on compliance with Art. 20.3.3 of the Administrative Code of the Russian Federation of the Constitution of the Russian Federation. “A court request to the Constitutional Court is the only way now to achieve recognition of this norm as unconstitutional,” explained Mr. Peredruk. .— “b”), but I do not know that the courts have satisfied at least one such appeal of the defense in cases of defamation.” Oleksandr Peredruk explained the need to check the norm by saying that it “does not allow any criticism, no freedom of expression.” In total, according to the “Network Freedoms” project, since March 5, more than 3.3 thousand protocols have been drawn up in the Russian Federation on discrediting the Russian army.
