The HOA sued Volochkova for 40 thousand rubles. The Tverskoy District Court of Moscow determined to recover in favor of the HOA “Italyanskaya Street, Building 4” from Anastasia Yuryevna Volochkova the costs of legal services when considering a civil case dated May 18, 2023. Initially, according to the court’s decision, Volochkova was charged about 60 thousand rubles as part of the costs of legal services during the consideration of a civil case and transportation costs. After an appeal, the amount was reduced to 40,000.

“I don’t owe anyone anything, they owe it to me, not me,” Anastasia Volochkova answered MK’s question. The artist suggested contacting her lawyer.

And then there was a flood, and the ballerina has been conducting examinations for more than a year and cannot recover compensation for the damage caused to her,” Roman Popov, lawyer of the MCF (Moscow Central Branch) of the Moscow Regional Bar Association, told MK. – The statement of claim was filed with the Tverskoy District Court more than a year ago by Ms. Lyubomskaya. The other day a decision was made on mandatory payments. She filed an application to recover 50,000 rubles for legal costs in the appellate and cassation instances. The court reduced the amount to 40,000. These are mandatory payments and are recovered from the losing party.

Anastasia had a dispute after neighbors flooded Volochkova’s St. Petersburg apartment last year, and the ballerina, out of emotion—not agreeing with the injustice—did not pay for the HOA’s services for several months. Since these are mandatory payments, these costs were eventually recovered from Volochkova. Utility services voluntarily refused to pay the injured party money for being flooded. Currently, a claim is being considered to recover from the HOA the damage caused by the flooding of my client’s apartment.

The lawyer recalled that Volochkova had a similar trial in Astrakhan, where more than 5 million rubles were recovered from the defendant in her favor. Enforcement proceedings have been initiated, but the money is not transferred, since the legal entity does not have funds in its account.
