“United Russia”: the introduction of criminal liability for evasion of mobilization is not considered

The draft law on the introduction of criminal liability for evasion of military service during the period of mobilization is not being considered. The State Duma explained that partial mobilization has been completed, so the draft law has lost its relevance.

In a joint comments Andrei Kartapolov, Chairman of the State Duma Defense Committee, and Vasily Piskarev, Chairman of the Security Committee, say that the bill was developed in order to “equalize responsibility for evasion between conscripts and mobilized citizens.” The fact is that after the announcement of partial mobilization, it turned out that Art. 328 of the Criminal Code of the Russian Federation for draft evasion applies only to conscripts.

Earlier today, on November 1, it became known that the deputies Andrey Kartapolov, Viktor Bondarev and Vasily Piskarev developed a bill that would punish draft evaders in the form of a fine of 200,000 to 500,000 rubles. or in the amount of income for one to three years, forced labor or imprisonment for up to five years. The bill has not yet been submitted to the State Duma.

At the beginning of October it was excited the first criminal case on evasion from mobilization under Part 1 of Art. 328 of the Criminal Code of the Russian Federation, but a few days later the prosecutor’s office canceled the decision to initiate proceedings. Andrei Klishas, ​​head of the Federation Council Committee on Constitutional Legislation, explained that cases under this article can only be initiated against conscript draft dodgers. He said that the question of the need to amend the legislation in this part is subject to “detailed discussion” with the State Duma.

Today Mr. Klishas named the bill developed by the deputies on the punishment of deviators is irrelevant, since partial mobilization has ended. Vladimir Putin announced the completion of partial mobilization on October 31. The Kremlin believes that there is no need for a separate decree confirming the completion of mobilization.
