The consequences of the terrible transport collapse that occurred at the Odintsovo MCD-1 railway station were visible on Thursday until the evening. More than 18 trains were left off schedule because one morning train derailed. Thousands of people were unable to get to work. “MK” found out from the expert whether they face fines and dismissal.

The train, which ultimately paralyzed traffic on the Belarusian direction of Russian Railways, left the depot just at the Odintsovo station, and one wheel pair of the car jumped off the rails. At the same time, the contact electrical network was broken, and all electric transport heading towards Moscow froze in place. At several railway stations, simply wild crowds of people formed.

“I usually go to work on the Lobny train, which arrives at the platform at 7:16,” said Alina, a resident of Odintsov. – So I make it to the office, which is located on Oktyabrsky Pole, at half past eight. This time there were so many people on the platform that even if train service had been restored quickly, we simply would not have all left. We had to storm bus stops and try to get to Victory Park. But there were so many people there who wanted to leave that it was simply impossible to squeeze through. And the car sharing was all snapped up in about 10 minutes. In the end, miraculously, I found a ride with another girl. We paid the driver for gasoline, which is 4 times cheaper than a taxi.

According to her, the bosses reacted quite calmly to her lateness; they didn’t even need photographic evidence. Information about the transport collapse appeared on social networks before she wrote to her manager about force majeure.

From about half past ten in the morning, trains began to travel at increased intervals. Not 30 minutes of travel, but all 50 were spent by passengers on the road.

— All employers are different, and some do not care about transport problems. They still threaten to fine or fire the employee, especially if he is on probation or has once fallen out of favor. A good reason to get rid of an unnecessary employee,” explained lawyer Alexander Chernetsov.

According to the specialist, management has the right to impose sanctions on an employee if he is absent from the workplace for more than four hours. No explanations or notices. However, a transport collapse, confirmed by representatives of the transport company, is a valid reason for the employee’s failure to appear at the company.

To do this, the employee needs to obtain a certificate of transport disruption from the information desk of the station or from the Central Suburban Passenger Company (CSPC). First you need to submit an application, indicating in what form the document is needed – paper or electronic. Paper certificates are issued at ticket offices, and electronic certificates are sent to the passenger’s mail. Additional evidence may include purchased tickets and other travel documents.

For absenteeism, you can fire an employee under two articles: Article 81 of the Labor Code of the Russian Federation “Violation of labor discipline” and Article 192 of the Labor Code of the Russian Federation “Disciplinary liability” are applicable to resolve this issue.

But in case of lateness for reasons beyond the employee’s control, these articles are not applicable, since, firstly, this is a one-time delay, and not systematic, and secondly, the employee can provide evidence of his conscientiousness in the form of a certificate from the CPPC.
