State Duma Chairman Vyacheslav Volodin instructed to prepare amendments on the preferential right of the closest relatives of orphans to become their guardians, the Duma’s press service reported on Wednesday.
“That’s right… to adopt a resolution on the first reading, which will indicate that by the second reading we will return to this issue and consolidate these norms as norms of direct action in the law,” Volodin was quoted as saying from the Duma Council meeting by the press service.
Volodin instructed the committee on family, women and children to prepare a draft resolution, as well as work out the relevant amendments for the second reading.
According to his proposal, the closest relatives of orphans – grandparents, adult brothers and sisters and other relatives should have the priority right to become the child’s guardian, without requirements for their living conditions, mandatory psychological testing and training for guardianship.
Amendments are proposed to be made to the government bill on additional requirements for future guardians of orphans
Volodin noted that “we are talking about protecting the rights of children” and that the issue was discussed with Prime Minister Mikhail Mishustin during the government report. In the draft law introduced by the government, as the speaker of the State Duma explained, close relatives are put “in the general list of persons” applying for guardianship and “if their living conditions are cramped, they may not receive the right to guardianship, and the child will go to an orphanage.” And this, as Volodin noted, is unacceptable.
