Among the documents adopted on Tuesday, there are both topical and high-profile ones.

A couple of bills were adopted in the first reading on simplifying and shortening the procedure for recognizing a serviceman as dead or missing. The second option allows you to correct errors.

The bill is called “On Amendments to the Civil Procedure Code of the Russian Federation and Certain Legislative Acts of the Russian Federation” and “On Amendments to the Federal Law “On Enacting Part One of the Civil Code of the Russian Federation”.

The speaker, Chairman of the Committee on State Building and Legislation Pavel Krasheninnikov, explained the following:

“If a serviceman died and there are witnesses to the death (commander, colleagues, other citizens), accordingly, a document of the established form is issued, this form will be established by the Government of the Russian Federation, and, accordingly, on the basis of this document, certificates of state registration will be issued. I draw your attention to this, it will be an administrative procedure.

If there is no information about the place of stay of a serviceman at his location, but there is also no person, here is the procedure, it is in the civil code today, but here it is also special. In these situations, there is a chance that the person is still alive, and, of course, civil law provides for the recognition of a person as missing, establishing custody of his property so that the property does not go anywhere, and until those circumstances are confirmed – he is alive or not alive, of course , this property will be protected by law, appropriate persons for protection will be appointed. The government will also, in accordance with this law, approve the form of this document.

If there were events that testified to death, but no one saw the fact of the death of a particular person. There is a procedure here called “declaring the deceased”, here the rules are also clarified, the terms are reduced. And in this case, of course, it is important that the declaration of death, as well as the declaration of death in an administrative order, here it is equated to death, respectively, families receive all the payments that are due to them by law and plus an inheritance is opened, and, accordingly , families can receive an inheritance, respectively, according to the current legislation.

Krasheninnikov especially noted the reduction in terms.

Protracted disputes were caused in the Duma by a deputy bill of the first reading on simplifying the procedure for employment of adolescents in their free time called “On Amendments to the Labor Code of the Russian Federation in Part of the Regulation of the Labor of Workers under the Age of Eighteen”.

The consent of one of the parents will be sufficient. The consent of the guardianship service remains for orphans.

Age does not change – from 14 years. The Ministry of Labor will develop a recommended list of jobs, now there is a list of prohibited ones for teenagers. The authors of the bill are seeking the consent of the government not to include the earnings of a teenager in the family income in order to maintain the allowance.

Supporters of child labor referred to the fact that most of the deputies began their labor activity before the age of majority. Opponents said that the child’s work is learning. Child labor will remain for the poor, while the rich will rest.

Here I must note that the prohibition of the labor of children and prisoners is an obligation to the West, and for this reason alone the law is worth passing. On any issue with signs of external interests, some kind of campaign in the media is sure to be launched, and the Communists are active in the Duma. Moreover, the deputies are more convincing than the journalists.

In practice, anyone who wants to work works without registration and, accordingly, without guarantees of compliance with labor rights, because it is impossible to comply with the bureaucratic procedure for registration. Whether it will be possible after the adoption of the law is not yet clear.

The government bill “On Amendments to Article 13.46 of the Code of the Russian Federation on Administrative Offenses” was adopted in the first reading.

Extraordinary deputy Vladislav Reznik insisted on consideration in the first reading of the draft law “On Amendments to the Federal Law” On State Regulation of the Production and Turnover of Ethyl Alcohol, Alcoholic and Alcohol-Containing Products and on Limiting the Consumption (Drinking) of Alcoholic Products.

The bill raises the requirements for the authorized capital of organizations applying for a license for the production of ethyl alcohol from 10 to 100 million rubles.

The argument of the authors is that the increase in requirements will reduce the number of subjects of production and it will be easier to control them.

Deputy Reznik’s initiatives have an exciting effect on his colleagues in the Chamber. At first they try to evade them, then they attack with criticism.

Mikhail Delyagin said that the flow of private politics uses deputies in a very unseemly role. Even before the outbreak of coronavirus, we saw that the worsening economic situation is leading to the fact that big business, which previously did not notice its smaller colleagues, begins to not only notice them, but also perceive them as their most serious competitors. “Colleagues, do we have evidence that counterfeit products are produced at relatively smaller enterprises? In my opinion, today it can be produced everywhere and, moreover, it is produced in a wide variety of facilities.

If we really want, as it was rightly said here, to make it easier to control, well, colleagues, introduce a state monopoly,” Mikhail Delyagin said about Vladislav Reznik’s bill.

Officials’ resistance to parliamentary initiatives will obviously require some special solution. It is unacceptable to solve obvious problems in such a way as it turns out with a trash stream. Starting with a precedent in the form of apartment raiding, parliamentarians are given the condition to adopt a separate law, and then insurmountable obstacles are created for its adoption. The absence of superfluous law serves as the basis for the prosperity of crime.

The fight against loans in someone else’s name is built in a similar way. The bank reports taking a loan to the phone number indicated by the scammer.
