He was accused of drunk driving
The Supreme Court of the Russian Federation decided to reconsider the case of a motorist from the Voronezh region, who was punished for driving a car after drinking Valocordin. Previously, courts of all lower instances found him guilty.
The controversial incident occurred in February. A traffic police inspector stopped a Voronezh resident’s car to check his documents, and the driver’s behavior seemed to him inappropriate to the situation. He asked him to blow into the tube, and although the man followed the instructions, the inspector decided that he had done it incorrectly. Therefore, in the protocol, the traffic police officer wrote that the driver refused to undergo the procedure. The driver was offered to undergo a medical examination, and he agreed.
His tests revealed phenobarbital, the main component of Valocordin, which the citizen took on the recommendation of a doctor. The substance is on the list of psychotropic substances, the circulation of which is limited in Russia, but drinking Valocordin is not prohibited. However, the doctor’s report indicated that the driver was intoxicated. As a result, the magistrate made the usual decision in such cases: deprivation of the right to drive for one and a half years and a fine of 30 thousand rubles. The man was not happy with this and tried to challenge the verdict. An argument in favor of the citizen was that during the examination a device was used that did not comply with existing standards. In particular, it does not print the results and only stores the results of the last 10 tests performed. But the courts of appeal and cassation were not convinced by the car enthusiast’s arguments.
But the Supreme Court sided with him. The decision of the highest authority states that the courts did not take into account the important circumstances of the case, therefore their decisions were canceled, the case was transferred for a new trial to the magistrate.
