The Supreme Court has banned the dismissal of a dentist for refusing to work as a cleaner.

The Supreme Court ruled that a dental therapist should be reinstated and paid a salary for his forced absence. Previously, a woman was fired because she refused to go to work as a low-skilled specialist.

The conflict began after a resident of Klimovsk, Moscow region, a dental therapist, became seriously ill. She spent several months on sick leave, and then received group II disability for several months. She could not work in her specialty. She was prescribed a rehabilitation program. Having familiarized themselves with the legislation, the management of the clinic found out that with such a diagnosis, a dentist can work as a computer operator, a cleaner of office premises, a janitor, and a typist for washing and repairing work clothes. This was offered to her, she refused, after which the woman was fired.

The lady considered this unfair and filed a lawsuit. Instance after instance refused to satisfy her demands: to be reinstated at work and to pay the money that she did not receive due to temporary inaction. The case was decided in the Supreme Court. The highest court pointed out that determining the suitability or unsuitability of an employee to perform certain types of work is not a method for determining what work a person with a disability is suitable for. This is an indication of what he cannot do. Therefore, it is illegal to offer a dentist to work as a janitor and fire him for refusing to do so. The decisions of the two lower courts were overturned.
