The Supreme Court of the Russian Federation ruled that a tool for committing an economic crime is not subject to confiscation if it is the main legal source of livelihood for the perpetrator. The court ruling, issued after the complaint of a man whose tractor was confiscated, leads RAPSI.
The Supreme Court considered the complaint of the convicted for illegal logging of forest plantations. As part of the verdict, a tractor and a chainsaw were confiscated from him. He asked to cancel the sentence regarding confiscation of property, since the tractor is the main source of funds for his family. It provides transport services in rural areas.
The court of first instance ruled that the chainsaw and tractor were tools for committing an economic crime, and therefore subject to confiscation in favor of the state. The ruling of the Supreme Court states that in each case, the decision on confiscation must be made based on the “specific circumstances of the criminal case.”
