More than 118 thousand rubles were sued by a buyer from an electronics store who sold an old iPhone under the guise of a new one. The payment amount was three times the cost of the smartphone.

As MK found out, some time ago Muscovite Alexey (name changed) bought an iPhone 11 model in one of the online stores. The purchase cost 38,000 rubles, and the man paid another 400 rubles for delivery. On the virtual showcase, the gadget was positioned as completely new.

Upon a quick inspection, the condition of the phone did not raise any suspicions in Alexey. However, during use, it became obvious that the gadget was not only used, but also contained a number of malfunctions. Thus, the iPhone constantly froze for no reason, its GPS module did not work, and when you pressed the screen, “clicks” were felt, which indicated a loose fit of the glass. In addition, the owner found rough traces of glue under the glass of the rear panel.

The judge sided with the client: the store was obliged to sell goods of proper quality. Since the defendant did not return the money voluntarily, after the intervention of Themis, the amount increased significantly. Now, according to a court decision, the owner is obliged to pay the buyer more than 118 thousand rubles. This amount includes the cost of the smartphone with delivery, a penalty and a fine (38,380 thousand rubles each). As well as compensation for moral damage – 2000 rubles, and postage costs – 400 rubles.
