The State Duma extended the law on “dacha amnesty” for general buildings of SNT until 2031

The State Duma adopted a bill to extend the “dacha amnesty” for buildings and structures that belong to the common property of horticultural non-profit partnerships (SNT) and were erected before 2004. Now the simplified procedure for state registration of property rights and cadastral registration, which expired on January 1, 2024, will be available until 2031. The head of the Duma Committee on State Construction and Legislation, Pavel Krasheninnikov, said that in the near future another initiative on simplified registration of property – multi-family houses, bathhouses, summer kitchens and sheds – will be submitted to the State Duma.

On January 31, State Duma deputies in the third reading adopted a bill amending Art. 70 Federal Law “On State Registration of Real Estate”. We are talking about the extension of the so-called dacha amnesty in terms of buildings and public buildings of gardening and vegetable farming partnerships erected before December 29, 2004. These include, for example, garages, paths and gatehouses. The simplified procedure for state registration of property rights and cadastral registration of such property ended on January 1, 2024; now you can use it until 2031.

The “dacha amnesty” was first announced in 2006 to legalize houses built on plots for gardening, personal farming and individual housing construction (IHC) without permits for commissioning. During its operation, rights to 13.5 million houses were registered. In 2019, the list of property available for a simplified procedure for registering property rights was expanded – it also included buildings and public buildings of horticultural and vegetable farming partnerships. The simplified procedure for registering ownership rights to individual housing construction and plots has been repeatedly extended (in 2022 until 2031), in contrast to the period of validity of the “amnesty” for the common property of SNT, which ended in January 2024.

In November last year, a group of senators and deputies from United Russia (including Andrei Turchak, Andrei Klishas and Pavel Krasheninnikov) submitted to the State Duma a proposal to “synchronize” the simplified registration of individual housing construction and common property of SNT. According to the amendments, citizens will once again have access to simplified registration and cadastral registration of the common property of SNT – permission to put such buildings into operation will no longer be required, it is enough to have only a title document for the general purpose plot on which such buildings are located, as well as declarations certified chairman of the partnership.

After the adoption of the bill, the chairman of the Union of Summer Residents of the Moscow Region and State Duma deputy from United Russia, Nikita Chaplin, told RIA Novosti that the amendments would reduce “paperwork” and eliminate the need for litigation: “Often gardening partnerships do not have the funds to repair or improve common facilities use. Extending the dacha amnesty will help speed up the collection of funds for repairs, give the properties legal status and ultimately allow gardeners to start improving them,” the deputy added.

The head of the Duma Committee on State Construction and Legislation, Pavel Krasheninnikov, in turn, said that deputies will not limit themselves to a “dacha amnesty” of common property. In the near future, he explained, it is planned to introduce an initiative to the State Duma on simplified registration of multi-family houses, bathhouses, summer kitchens and sheds.
