The Public Chamber of Russia is ready to consider the State Duma’s proposal to introduce the death penalty for terrorism, reported “Izvestia” State Duma deputy from United Russia Alexander Spiridonov. Deputy Chairman of the OP Commission on Public Control and Work with Citizens’ Appeals Maxim Grigoriev told the publication that the chamber will discuss the initiative if it is submitted to the State Duma and the parliament sends it to the OP.

“Terrorism against defenseless people is the most disgusting and vile crime. There can be no mercy or forgiveness for such a person. It is impossible to atone for the guilt before relatives and society for any period of time, even lifelong. I believe that it is worth returning to consideration of lifting the moratorium and introducing the death penalty for terrorism into the Criminal Code,” the deputy told the publication.

Mr. Spiridonov said that work to lift the moratorium on the death penalty should begin with the formation of jury trials. Formally, the death penalty in the Russian Federation is provided for committing qualified murder (Part 2 of Article 105), an attack on the life of a statesman or public figure (Article 277), an attack on the life of a person administering justice or a preliminary investigation (Article 295), an attack on the life of a law enforcement officer (Article 317) and genocide (Article 357). Thus, even if the moratorium is lifted, the death penalty is not provided for those who committed a terrorist attack.

Mr. Grigoriev supported the inclusion of terrorism in the list of crimes for which the death penalty is provided. He believes that there is no need to talk about the risks of miscarriages of justice in such crimes. Terrorist attacks, as a rule, are of an obvious nature and obvious criminals, said the deputy chairman of the OP commission.

A representative of the Constitutional Court of Russia refused to comment to Izvestia on the possibility of lifting the moratorium on the death penalty, since in the context of discussing this problem in the current situation, the issue may become the subject of consideration by the Constitutional Court.

After the terrorist attack at Crocus City Hall, there were calls in the State Duma to return the death penalty. Three out of five parliamentary factions recalled that they have long been in favor of the return of the death penalty. The leader of United Russia, Vladimir Vasiliev, said that the return of such punishment “will meet the moods and expectations” of society. Head of the Human Rights Council (HRC) in Russia Valery Fadeev stated, that “for the duration of the war with the West” the death penalty can be returned for a limited list of articles, including terrorism. According to him, it will be possible to abolish the death penalty after “the situation improves.”

The head of the Federation Council Committee on Constitutional Legislation, Andrei Klishas, ​​wrote in his Telegram channel that “neither the Duma nor the Federation Council can overcome the decisions of the Constitutional Court of the Russian Federation on the issue of the death penalty.” Kremlin statedwhich is not participating in the discussion on lifting the moratorium.
