The Primorsky Regional Court upheld the appeal of the Ministry of Justice of the Russian Federation and overturned the decision of the court of first instance, which declared the inclusion of journalist Daniil Gubarev in the register of foreign agents illegal. The author of the Telegram channel, which criticized the regional authorities, was included in the list for distributing materials from other foreign agents and living abroad, but the Soviet District Court of Vladivostok considered these arguments unfounded. The defense of the journalist approved as a foreign agent called the decision of the regional court “expected.”
Today, October 4, the Primorsky Regional Court announced the operative part of its decision following the consideration of the appeal of the Ministry of Justice of the Russian Federation against the decision of the court of first instance, which declared the inclusion of journalist Daniil Gubarev in the register of foreign agents illegal. “The decision of the Sovetsky District Court of July 18 was canceled, a new decision was made in the case to refuse to satisfy the demands stated in the administrative claim,” Elena Oleneva, press secretary of the regional court, told Kommersant. Thus, Mr. Gubarev has been approved as a foreign agent.
Former journalist of the VL news agency from Vladivostok, Daniil Gubarev, author of the Telegram channel (35.7 thousand subscribers), who criticized the authorities of Primorye, recognized foreign agent in March 2023. The message from the Ministry of Justice explained that he “distributed materials created by foreign agents to an unlimited number of people,” and also “lives outside the Russian Federation.” The journalist challenged this decision, and on July 18, the Sovetsky District Court of Vladivostok declared his inclusion in the list of foreign agents illegal.
“The decision of the regional court did not cause surprise and was expected,” the journalist’s lawyer Sergei Valiulin told Kommersant. According to him, representatives of the Ministry of Justice did not present any new arguments in the appeal. “It was again said that Gubarev distributed materials from other foreign agents and lives in Singapore. We argued that there was no evidence that Gubarev was under foreign influence and received remuneration from representatives of other states for publications. The court of first instance agreed with our arguments, the regional court decided not to deviate from the general rule and support the Ministry of Justice,” the lawyer said. The possibility of further legal action will be discussed with the client after studying the reasoning part of the regional court’s decision, added Mr. Valiulin.
“I’m not at all surprised by the decision of the regional court, I will continue to fight,” Daniil Gubarev answered today in a messenger to Kommersant’s questions. Previously, he stated that he “absolutely disagreed” with the March decision of the Ministry of Justice (on recognition as a foreign agent). “I’m glad we won in court. But I won’t be surprised if everything is returned again,” the journalist said after the decision of the Sovetsky District Court. He explained his move to Singapore by saying that “the climate there is good.”
