Rospatent refused to register the Kaluga plant’s absinthe brand “Shaman” because of the singer’s pseudonym

The Russian plant was not allowed to register the Shaman brand of absinthe because of the pseudonym of singer Yaroslav Dronov. The refusal to register a trademark was also considered justified by the panel of the Chamber of Patent Disputes. This is stated in the conclusion of the board.

It is reported that the Kaluga Distillery tried to register the brand in August 2023, but was refused by Rospatent. The plant appealed the decision in October, but the panel upheld it.

The company hoped to produce Shaman products as early as January 2024.

Rospatent came to the conclusion that “the declared designation is the stage name of the artist SHAMAN – a Russian popular singer, poet and composer.” This coincidence could be misleading to buyers.
