The court overturned the acquittal in the case of corruption of orphanage pupils

On May 18, the Court of Cassation overturned the acquittal in a high-profile case of molestation of pupils in a St. Petersburg orphanage. The meeting was attended by two defendants. The third one was mobilized for the SVO in early May.

This story is five years old. According to investigators, the defendants in the case from 2005 to 2010 harassed children from the orphanage. The victims were between 10 and 15 years old at the time. The proceedings lasted almost four years. At the end of 2021, the Kirov court delivered a verdict of not guilty.

One of the victims is a boarding school student Yakov Yablochnik. Several other people testified.

There were five people in the main case. Two are no longer alive.

The last meeting was attended by the deputy director of the orphanage, Mikhail Yelin, and the graduate of the orphanage, Kirill Pokalyuk. The son of the school janitor, Pavel Prikashchikov, was mobilized.

The lawyer of the victim Alexandra Gudimenko commented on the situation.

“Today, no circumstances of the case were considered, only procedural violations were considered,” the lawyer says. – At the beginning of the meeting, all at that time still acquitted, and now the defendants, denied guilt.

Their lawyers said that they had children, the defendants themselves clutched at their hearts, demonstrating that they were not well. They were shocked when they heard the court’s decision. In the corridor they discussed how to proceed. I assume that they will write complaints.

Now the status of acquitted has been removed from them, they are defendants again. I was a little upset that the court did not resolve the issue of a measure of restraint. Although the prosecutor’s office petitioned to take them into custody for two months.

From a legal point of view, the case should go to a new trial in a different composition of the court. Each side will prove its right or wrong. In any case, this is a great victory for us, there is hope for justice for those who have been subjected to violence.

– One of the defendants in the case was mobilized. What to do with him, you can’t bring him back?

– Purely technically and legally everything is possible. But now such legislation… For example, I had cases when my clients, who were defendants at the first instance stage, expressed their will to go to the SVO. And they left.

If a person has not yet been convicted, there is no court verdict, then he can fulfill his duty in a special operation. If Prikashchikov is in the SVO legally, his case should be separated into a separate proceeding and suspended until the moment when he returns. And in relation to all the rest, the case should be investigated in the court of first instance.
