A partially closed window brought a man to the hospital
A passenger who fell seriously ill on a train due to a blown window was able to recover moral compensation from the transport company in court.
As it became known to MK, in early December 2018, Andrei Yuryevich, a former military man and now a financier in an investment company, bought a ticket for the Veliky Novgorod-Moscow train. The way home in a reserved seat car was, in principle, close – the road took only 8 hours. However, the trip turned into a real torment. The window, next to which Andrey Yuryevich was, was blowing strongly, by morning even frost had formed on it. Waking up early in the morning, the passenger felt unwell – he started coughing, his temperature rose, and he saw frost on the window. Upon arrival in Moscow, the man turned to the first-aid post of the Leningradsky railway station. However, the matter was not limited to hypothermia. Feeling worse and worse, Andrey Yuryevich called the local general practitioner from home, and two days later he was diagnosed with pneumonia of moderate severity. The disease was so severe that the Muscovite had to be hospitalized in a day hospital for two weeks, as other chronic diseases worsened, in particular, multiple sclerosis.
The man turned to the transport company with a complaint. He received the answer while he was in the hospital. The carrier apologized for the unpleasant trip and offered to earn 1,000 loyalty points. The Muscovite was not satisfied with such a proposal, he appealed to the Meshchansky District Court.
Representatives of the transport company at the trial denied guilt. The legal proceedings went on for quite a long time, but the other day the servants of Themis decided to recover 50 thousand rubles in favor of the victim in the form of moral compensation.
– Of course, this amount will not cover the cost of treatment, which lasted a very long time. Before the trip, I had a 3rd group of disability, and after a while the doctors diagnosed me with a 2nd group, – the Muscovite himself explained.
The decision has not yet entered into force – the transport company plans to file an appeal.
