The court sided with Forbes businessman Kirill Shamalov in establishing motherhood for his daughter. Earlier, his ex-wife Zhanna Shamalova turned to Themis with a corresponding lawsuit.
Recall that at the end of July 2021, Kirill Shamalov filed a lawsuit with the Khamovniki Court demanding that his marriage to Zhanna Shamalova (before Volkov’s marriage) be declared invalid. The author of the document indicated that the wife entered into a marriage with him solely for the purpose of obtaining property benefits: according to the marriage contract, in the event of a divorce, the businessman must transfer a large amount of dollars to the chosen one.
The scandal in the family of the oligarch developed, as the couple had a child, but the surrogate mother who gave birth to the girl disappeared. Zhanna Shamalova gave an interview to Ksenia Sobchak and wrote a number of statements to law enforcement agencies, including a journalist. In three instances, the courts refused to recognize the Shamalovs’ marriage as fictitious, but their daughter, as it turned out, had been with the billionaire all this time.
As it became known to MK, on February 8, the Moscow City Court upheld the decision of the Khamovnichesky Court to refuse to establish the motherhood of Zhanna Shamalova. Themis in her verdict relies on the decision of the surrogate mother to leave the baby with her father. It is noteworthy that the woman herself, who signed a contract for the birth of a child for the Shamalovs, abandoned the girl, and Kirill Shamalov is the only parent of the child.
“I consider this decision illegal. A surrogate mother can claim her right to a child if she suddenly has maternal feelings and is ready to raise her child herself. In this case, I will appeal the decision and demand to clarify what norm of the law the judges were guided by,” commented Zhanna Shamalova.
