The Ministry of Health proposed changing the rules for limiting the rights of psychiatric patients

The Ministry of Health has prepared a draft resolution that changes the rules for making decisions when limiting the rights of patients receiving psychiatric care in hospitals. This was reported to RIA Novosti by the press service of the Ministry of Health. The draft resolution has already published on the portal of draft regulatory legal acts.

According to the draft, restriction of a patient’s rights is unacceptable only on the basis of a psychiatric diagnosis, as well as the fact of being under dispensary observation or staying in a medical organization. The decision to limit a patient’s rights must be based on specific circumstances. Doctors will also have to indicate the form of restriction of the patient’s rights and the rationale for its choice.

The patient’s rights cannot be limited for more than 15 days, including the day the decision is made. However, this period can be extended if necessary. To do this, there must be a new decision on the restriction in the medical documentation.

The text of the draft states that it is designed to ensure respect for the rights and interests of patients. The project applies to the work of medical organizations providing psychiatric care in hospitals, state and municipal health care systems. In November 2023, Commissioner for Human Rights Tatyana Moskalkova asked the Ministry of Health to develop uniform rules for hospital procedures.

In August 2023 was accepted A law that removes the state’s obligation to establish independent services for people with mental disabilities. It is assumed that social activists will defend their rights.
