The Nizhny Novgorod OFAS refused to include in the register of unscrupulous suppliers NPF Orto-Cosmos LLC, with which the Social Fund decided to terminate the state contract worth 17.5 million rubles ahead of schedule. for the manufacture and supply of lower leg prostheses for people with disabilities. The supplier managed to transfer the first batch of 45 prostheses to customers, however, in April, employees of the Nizhny Novgorod Federal Security Service bypassed them without issuing acts confiscated 11 prostheses for testing. Then a criminal case was initiated on attempted fraud.
Withdrawal of prostheses provoked a scandal in the region. The FSB investigator conducted an examination of the non-compliance of the seized products with the terms of the state contract, and the director of the subcontractor company sent under house arrest.
At a meeting in the antimonopoly service, a representative of Ortho-Cosmos, Mikhail Rozhkov, said that they did not agree with the conclusions of the examination, which was carried out by the FSB without their participation, they considered the delivered prostheses to be of high quality, and the Social Fund did not provide them with complaints about products from customers. In ten days, the contractor made new prostheses to replace the withdrawn ones and provided letters from patients about the absence of claims.
Mikhail Rozhkov explained the involvement of the Nizhny Novgorod subcontractor by the fact that the company is heavily loaded with the manufacture of prostheses for military personnel from the special operation zone, whose limbs have been amputated as a result of wounds. The company also explained that the Nizhny Novgorod branch of the Social Fund “did not pay a penny” for the first batch.
The representative of the fund, in addition to the expertise of the FSB, referred to the fact that the contractor’s premises in Nizhny Novgorod did not meet the requirements of an accessible environment. However, the OFAS commission, having assessed the evidence of the parties, did not recognize Ortho-Cosmos as an unscrupulous supplier, deciding that the state customer violated the procedure for terminating the contract.
