Leading legal support specialist Center for Legal Assistance to Citizens in the Digital Environment Yakov Petrosyan explained what needs to be done if fraudsters have issued a loan in a citizen’s name.
In this case, the expert recommends that you contact the financial institution as soon as possible with a statement about the fraudulent transaction and request all documents that are related to this loan. Such documents include: a copy of the loan agreement, a copy of the loan application, a current bank account statement, a loan account statement, a payment schedule, a copy of the consent to the processing of personal data, a copy of the passport used to issue the loan, as well as a bank card/account number , which lists the loan amount and the phone number that was used to confirm transactions with this loan.
“Immediately contact the police department and report the fact of fraud, as well as all the circumstances that confirm your non-involvement in applying for a loan. Such circumstances include, for example, applying for a loan using a lost passport, the absence of a citizen at the place where the loan was issued. Provide details SMS for the period in which the loan was issued, or a statement about the loss of the SIM card”– the lawyer clarified.
According to him, if a financial organization does not respond to requests, you should contact the Central Bank of the Russian Federation with a complaint about the actions of the financial organization; this can be done through the online reception on the official website of the regulator.
If a citizen encounters difficulties when requesting documents or preparing a statement of claim in court, the lawyer advised to contact the Center, whose employees will provide all the necessary assistance free of charge.
