She further recommends finding out by calling the bank the procedure for sending a notification about an unauthorized debit of funds from an account. It is better to do this in person at a bank branch so that you can get a note on the copy indicating receipt of the notice, as this may be required for the court.
“In accordance with the law, such notification must be submitted no later than 1 day from the date of receipt of the message from the bank about the transaction. Request a certified account statement from the bank. The bank will consider your notification within the period stipulated by the agreement, but no more than 30 days from the date receipt of notification or no more than 60 days in the case of a cross-border transfer.By virtue of the law, the bank is obliged to return the amount debited from the account if two conditions are simultaneously met: firstly, if the client has not violated the rules for the safe use of an electronic means of payment (for example, a bank card, an application on mobile device), secondly, the client informed the bank about the unauthorized transaction no later than 1 day after receiving notification from the bank about such a transaction,” the Center’s lawyer emphasized.
In addition, you should immediately contact the police with a statement about the theft of funds from your account; it is advisable to attach a copy of the agreement with the bank and an account statement to the statement.
If the bank refuses to reimburse the written-off funds, you will need to go to court.
