The traffic police inspector’s offer to the driver who committed the violation to “agree on the spot,” that is, without officially paying a fine, is fraught with very serious consequences, said lawyer Anatoly Mironov.
In a conversation with the Prime agency, he noted that this usually happens when the driver commits serious violations of traffic rules. At the same time, Mironov warned that it is impossible to agree to such proposals, since, in addition to deprivation of a driver’s license, you can become involved in a criminal case. According to him, these acts are provided for in Article 291 or Article 291.2 of the Criminal Code of the Russian Federation, depending on the amount transferred. In both cases the crime is punishable by imprisonment, he said.
The lawyer recommended requiring a protocol to be drawn up and reminded that even the most serious administrative punishment cannot be compared in severity to a criminal one.
