The lack of thermometers in the warehouses where beer is stored, cracks and chips on the walls, as well as traces of rodents – these circumstances could have caused the closure of the capital’s Mutabor club for 90 days. The meeting of the Lefortovo court in the framework of Rospotrebnadzor’s claims against the owner of the Mutabora trademark, Art Center LLC, for violation of sanitary and epidemiological requirements was held behind closed doors, but Kommersant obtained the materials of the case. Earlier, Anastasia Ivleeva’s scandalous “naked party” took place in Mutabor, after which the organizers were accused of promoting LGBT people and violating traditional values. The lawyer calls the procedure for suspending the activities of a public institution for 90 days standard for Russia, adding that if desired, violations of SanPiN can be found “almost everywhere.”

On Wednesday, the Lefortovo Court of Moscow suspended the operation of the Mutabor club for 90 days due to violations of a number of sanitary and epidemiological standards in the establishment. The corresponding protocol regarding the owner of the Mutabora trademark, Art Center LLC, was drawn up by Rospotrebnadzor.

Let us remind you that problems for the owner of Mutabor arose after blogger Anastasia Ivleeva hosted a “naked party” at the establishment on the night of December 21. Footage from the event spread on social networks, after which a number of politicians and public organizations contacted law enforcement agencies with a request to evaluate the event. They accused the party of promoting LGBT people and violating traditional values, emphasizing that the event was inappropriate during a special military operation.

One of the participants, rapper Vacio (Nikolai Vasiliev), was fined 200 thousand rubles the next day. under articles of hooliganism and LGBT propaganda and was arrested for 15 days.

Mr. Vasiliev apologized directly from the special detention center for “offending the feelings of many people in such a difficult time.” Later, he was sentenced to another 10 days of administrative arrest for petty hooliganism and resisting police officers. Other participants in the event also had to publicly justify themselves, and the hostess of the party, Anastasia Ivleeva, promised to send the proceeds from ticket sales to charitable organizations. Despite this, on December 29 the court fined her 100 thousand rubles. for organizing an event that resulted in a violation of public order. Also, a lawsuit was filed in the Khamovnichesky Court of Moscow from producer Alexander Inshakov and a group of citizens against Ms. Ivleeva for 1 billion rubles. for compensation for moral damage. On Wednesday it became known that the lawsuit was rejected for formal reasons.

In Mutabor, where the party took place, employees of Rospotrebnadzor and law enforcement agencies came to check on December 27, the establishment was sealed. During the New Year holidays, the owner of the club, Mikhail Danilov, donated fragments of the relics of St. Nicholas the Wonderworker to the Moscow Church of the Icon of the Mother of God.

“We have several clubs, including Mutabor, known for the latest events,” Mr. Danilov said at the same time. “But we are against obscurantism, we support the church.”

According to the entrepreneur, he purchased particles of the relics from the Vatican and was waiting for Christmas to hand them over.

Mr. Danilov refuses to comment, but, according to the Mash Telegram channel, Mutabor management plans to sue Anastasia Ivleeva for 70 million rubles. According to the channel, the organizers of the party signed an agreement under which they guaranteed not to break laws and not discredit the establishment. Mutabor believes that the “naked party” has seriously damaged the establishment’s reputation.

The press service of Rospotrebnadzor told Kommersant that the results of the inspection were submitted to the court, but the agency does not have the right to provide documents, since the case was heard behind closed doors.

Lawyer Irina Chepaikina, who represented the interests of Art Center LLC, also refused to comment on the court’s decision, telling reporters that she “does not have the authority to do so and is only getting acquainted with the case materials.”

A Kommersant source familiar with the case reported that Rospotrebnadzor had identified a number of violations of sanitary and epidemiological standards at the club. In particular, “there are traces of rodent activity in the room,” and disinfestation measures are carried out incorrectly. Also, in the warehouses where beer is stored, the materials say, there are no thermometers or instruments for monitoring temperature and humidity conditions of storage, and traces of dirt and dust were found on the walls, ceiling, flooring, bar counters and technological equipment. The condition of the club premises is assessed as “extremely unsatisfactory”: cracks and chips were found on the walls and floor, and the coating was peeling off from the ceiling. All this “makes it difficult to clean and disinfect the premises” and can allow insects and rodents that carry diseases to enter the club. Inspectors did not rule out “foreign objects getting into food products,” which could, in turn, lead to “mechanical damage to the internal organs” of visitors.

The Lefortovo Court of Moscow suspended the work of the Mutabor club for 90 days under an article on violation of sanitary and epidemiological requirements (Article 6.6 of the Code of Administrative Offenses of the Russian Federation). The period is calculated from December 27. According to TASS, the demand to bring the club owners to administrative responsibility may also be related to the presence of an infectious patient at this party, but there is no official confirmation of this.

“90 days is the standard period for suspending the work of an establishment to correct violations that cannot be corrected immediately,” Aram Muradov, a lawyer at the Minushkina and Partners bar association, commented on the court decision. “If the organization copes faster, it can go to court to reduce the time of suspension of activities.” . At the same time, Mr. Muradov noted that the stereotype that, if desired, one can find a violation in the organization of work of almost any establishment, “in general has to do with reality”: “SanPiN were developed back in the Soviet Union, they are updated very slowly. Therefore, a business that uses new technical solutions and operates according to modern standards may not meet sanitary standards, since it has simply overtaken them.”
