The Frenchman was not allowed to take his children out of Russia

In the Kurgan region, a mother of two children won a lawsuit with their father, a French citizen, over the place of residence of their minor daughter and son. The Ombudsman said that such a court decision was based on a psychological examination – the court took into account the opinion of an expert who decided that for the children of this couple, moving to France, even with their mother, would be psychologically traumatic.

As Lopatina noted, from September the children will go to school in the Kurgan region, where their mother bought a house using maternity capital. According to the Commissioner for Human Rights, this family has a well-established life, the children have formed a social circle, and they communicate with their father via the Internet.

Earlier, URA.RU reported that a resident of France, with whom the Russian woman was not officially registered, is trying to sue the children of a resident of the Kurgan region. A woman took her six-year-old son and eight-year-old daughter, who have French citizenship, to Russia in secret from their father at the end of 2019. Now the children are Russians. A girl in the Kurgan region went to elementary school, and a boy went to kindergarten. The mother did not forbid the father to see the children and offered him to move to the Russian Federation himself.

The Zheleznodorozhny District Court of Yekaterinburg, which considered this case in the first instance, considered that the children would be better off with their father in France, despite the fact that the man was unemployed at that time.

However, the guardianship authorities and Alena Lopatina, Commissioner for Children’s Rights in the Kurgan Region, took the side of the mother of the children, who appealed against the decision of the Railway Court. The higher court ruled to the contrary.
