The prisoner received a symbolic 1000 rubles for 30 refusals in a conversation with a lawyer
Surprising in modern times, although purely symbolic, victory over the Investigative Committee was won in court by the former head of the Ruza urban district of the Moscow region, Maxim Tarkhanov. The man obtained compensation – albeit a very modest one – for a failed conversation with a lawyer.
As it became known to MK, Tarkhanov bombarded the courts with complaints from the very first day of his stay in the pre-trial detention center. The head of Ruza was arrested in February 2021. He was accused of embezzling 500 million rubles allocated for the construction of treatment facilities in the city district.
The prisoner’s claims concerned mainly communication with the outside world. Thus, the investigator flatly denied the accused additional telephone conversations with his wife and conversations with a lawyer. The number of failed dialogues with the defender generally exceeded all norms of decency: Tarkhanov was refused 30 (!) Times. He filed an application with the Basmanny Court. The servants of Themis admitted that the official’s attempts to achieve unnecessary conversations with his wife were groundless (after all, they did talk twice). But the investigator’s unwillingness to give permission for Tarkhanov’s conversation with a lawyer was assessed by the court as illegal.
The stubborn defendant did not stop there. He filed a lawsuit against the ICR for compensation for moral damages for the arbitrariness of an investigator. And here, oddly enough, he won. True, the Basmanny Court awarded Tarkhanov only 1,000 rubles – apparently as moral satisfaction. By the way, the UK does not want to part with this amount either: the court’s decision is being appealed.
