The Supreme Court of Crimea rehabilitated the leader of the Sevastopol-Crimea-Russia movement Valery Podyachey, who was convicted in Ukraine for separatism. Kommersant was informed about this in court.
Two Crimean political activists – Valery Podyachey and Semyon Klyuev, conditionally convicted in 2009 for “violating the territorial integrity of Ukraine.” After the peninsula became part of the Russian Federation, Crimeans appealed this decision to the Kiev District Court of Simferopol. However, in August 2017, the court ruled that Valery Podyachiy and Semyon Klyuev committed a crime against the national security of Ukraine.
In December 2017, the Supreme Court of Crimea overturned the verdict of the Ukrainian court, but denied the activists the right to rehabilitation.
In the winter of 2018, the judicial panel for criminal cases of the Supreme Court of the Republic of Crimea also refused to satisfy their appeal. Due to his criminal record, Valery Podyachiy could not work in his profession and teach all these years.
In the summer of 2023, the Fourth Cassation Court of General Jurisdiction in Krasnodar upheld the complaint of Valery Podyachey and sent the case for re-appeal consideration to the Supreme Court of Crimea, but with a different composition of the court, which subsequently decided to expunge the criminal record.
According to Valery Podyachey, which he expressed in a conversation with Kommersant, such a long and complex rehabilitation process was due to the fact that his case was considered by former Ukrainian judges who went to work in Russian courts. According to him, the decision of the cassation court radically changed the situation. Semyon Klyuev died in 2017. It is expected that he will soon be rehabilitated – posthumously.
Kommersant wrote in an article about how the ex-governor of Sevastopol stood up for those who “waged war” for the return of Crimea “Crimean patriots need rehabilitation”.
