The Beloyarsky District Court (Sverdlovsk Region) on Friday, December 2, satisfied the claim of the Zemlyanykh family with many children to declare illegal the order to terminate custody of three adopted children, as well as the act of checking their living conditions, observing their interests and duties of guardians. In total, there are five adopted children in the family, two of them remain in the orphanage, as they had previously written a complaint to the guardianship authorities about the cruel treatment and violent actions of the guardian. In addition to the five adopted children, the family brings up three of their own.
How informed “Kommersant”, at the end of August 2022, the guardianship authorities seized the foster children of Victoria Zemlyanoy due to a complaint from the adopted son and daughter about abuse. The conflict in the family, according to Mrs. Zemlyanoy, occurred because she took the mobile phone from her eldest daughter. After her complaint, the guardianship authorities came to the school where two more of her adopted sons are studying and took them to an orphanage. The head of the family at that time took part in a military special operation in Ukraine.
One of Victoria’s younger adopted daughters, Zemlyanoy Court, was allowed to stay at home until the lawsuit was decided. According to the woman, the adopted son and daughter, who filed a complaint about ill-treatment, remain in the orphanage of their own free will. “Children who wrote the application themselves remain in the system. It is clear that we are halfway there, there will be appeals. They are trying to hang criminal cases on us that we allegedly beat children, and, of course, we will continue to wallow with this, but the fact that the first step in our favor is very, very pleasing, ”Victoria Zemlyanaya told Kommersant. Note that the children will be able to return to the family after consideration of the appeal, if it goes to the decision of the first instance.
Family lawyer Nikita Sorokin said that the court also issued a number of private rulings. The court pointed out to the director of Beloyarsk school No. 1 that the interests and legal rights of minors were not respected, as well as the need to strengthen control over subordinates in order to monitor compliance with the rights of minors. The head of the department of social policy No. 10 of the Ministry of Social Policy of the Sverdlovsk Region issued a ruling on violation of the requirements of the legislation on guardianship and guardianship, which leads to a gross violation of the rights of minors. “The principal of the school and the head of the department will have to report to the court on the work done to eliminate violations,”— wrote lawyer on his page in VKontakte.
