Doctors performed surgery on the wrong vertebra

Almost two million rubles should be paid by the clinical hospital on the Yauza to the multiple winner of the European Championships in Brazilian jiu-jitsu Mikhail Shishuk. The Noginsk City Court of the Moscow Region came to the conclusion that the hospital performed unnecessary spinal surgery on the athlete.

Shishuk filed a lawsuit in December 2021. He indicated that he had gone to a medical facility complaining of severe back pain. This happened to him before: he has been wrestling since the age of six, which naturally affected the health of the athlete. In 2017, at the Sechenov Hospital, a herniated vertebra in the lumbar region was removed. This time he also turned there, but he was disappointed with the doctor’s answer: the recovery period after the next operation required six months, and he could only participate in competitions in a year. This did not suit the wrestler: going under the knife meant refusing to participate in the next European Championship. Therefore, the athlete decided to look for an alternative. A doctor from the hospital on Yauza assured that he would be able to return to training three days after the operation, and two weeks later he would fully recover. The services of a private clinic cost Shishuk 624,100 rubles, but the operation did not help: soon the pain intensified, the foot began to go numb. The examination showed that the doctor performed the operation on the wrong vertebra. And the vertebral hernia, which had to be operated on, only increased. The athlete’s family demanded the clinic to return the money, but to no avail. Then Shishuk went to court. He demanded to recover from the defendant all the money paid to the clinic, the same amount as a penalty, 3 million as compensation for non-pecuniary damage, a fine in the amount of half of the satisfied claims, as well as 70 thousand rubles to compensate for the costs of examinations that had to be done from – for poor quality of the operation.

The experts involved by the court came to the conclusion that the operation was carried out normally, and there were no complications after it. True, the athlete did not need it, and the one that was needed was not carried out. As a result, the court satisfied the claims in part, obliging the hospital to return 624,100 rubles to the plaintiff, pay the same penalty, compensate for moral damage of 10,000 rubles, and also pay a fine of 50% of the amount awarded. In total – 1,887,300 rubles. However, the medical institution is trying to appeal the court’s decision.
