The Frunzensky District Court of St. Petersburg fined lawyer Ivan Pavlov (recognized as a foreign agent in the Russian Federation) in the amount of 30,000 rubles. under Art. 19.34 hours 3 of the Code of Administrative Offenses of the Russian Federation. Ivan Pavlov, the founder of the Team 29 law community, has been specializing in criminal cases of treason, extremism and protecting citizens from state security agencies for more than 20 years. In particular, he represented the interests of the journalist Ivan Safronov, who was accused of treason. The Ministry of Justice added Ivan Pavlov and his colleagues to the list of foreign media agents in November 2021. Ivan Pavlov has been brought to administrative responsibility for failure to fulfill the duties of a foreign agent for the fifth time. Since 2021, he has not lived in Russia and has been put on the international wanted list.
Ivan Pavlov told Kommersant that his lawyer Alexander Peredruk was going to challenge the court’s decision. Roskomnadzor and the Frunze Court, he explained, believe that the offense was committed on January 10, 2023 in St. Petersburg. Meanwhile, Ivan Pavlov has not lived in the country for several years. “I’m not even registered in Russia, but my opponents still won’t calm down. As for marking, I don’t plan to put “foreign agency” plates further, because I don’t see the point in this, and I try not to do senseless actions,” Ivan Pavlov explained.
“According to the law, an administrative offense, with rare exceptions, can only be committed on the territory of Russia,” Mr. Peredruk noted in turn. “Then why was my principal held accountable for a post that was published outside the country? Territorial jurisdiction is determined by the place where the offense was committed. And in our case, the place is chosen arbitrarily. This gives us grounds for filing a complaint. It will be interesting to see the reasoning of the court.”
In Art. 19.34 of the Code of Administrative Offenses at the end of last year, changes were made in connection with the entry into force of a new law on control over the activities of persons under foreign influence. The current fine is the first in a case brought under the new law on foreign agents, notes human rights activist Pavel Chikov.
