The Russian Constitutional Court ruled that the treatment of stray animals must be humane and comply with the law on the responsible treatment of animals. In this regard, federal laws and municipal acts should be finalized, it follows from the resolution (.pdf).
The court considered the case at the request of the administration of the city of Novodvinsk, Arkhangelsk region. Lower courts ordered the mayor’s office to pay 300 thousand rubles. local veterinary station for the maintenance and burial of stray animals. From court decisions it followed that the Civil Code obliges municipal authorities to take ownership of stray animals. The administration challenged this decision in the Constitutional Court, since it did not express such a desire.
The Constitutional Court ruled that the norm prescribed in the Civil Code does not contradict the Constitution. However, it cannot be used in circumstances related to keeping animals without owners, it follows from the resolution. In this regard, the Constitutional Court sent the claim to the Novodvinsk administration for new consideration.
The issue of transferring powers to deal with stray animals to local government needs to be finalized, the Constitutional Court added. The capture, maintenance and return of animals to their owners, as specified in court, must be humane.
On July 24, Russian President Vladimir Putin signed amendments to the law on the treatment of animals. Regional authorities have the right to independently establish measures to control the number of stray dogs. This includes, among other things, the possibility of shooting animals.
