The case of actress Asmus about discrediting the army was dismissed due to the lack of corpus delicti

The Tverskoy Court of Moscow terminated the proceedings on the administrative case of discrediting the Russian army against actress Christina Asmus. Earlier, Ms. Asmus published a post on Instagram (owned by Meta, recognized as extremist in the Russian Federation and banned), in which she expressed her negative attitude towards the military operation in Ukraine.
“The decision has been made, the proceedings have been terminated, due to the lack of corpus delicti,” said the actress’s lawyer Vladimir Lyakhovsky (quote from RBC).
The case of an administrative offense h. 1 Article. 20.3.3 of the Code of Administrative Offenses of the Russian Federation (public actions aimed at discrediting the use of the armed forces of the Russian Federation) was submitted to the court on August 25, 2022. The maximum punishment under this article is 50 thousand rubles. The reason for the protocol is not specified.
On February 24, on her Instagram page, the actress published a post with a black square and the caption “Fear and pain. Please stop all this.”
Mr. Lyakhovsky noted that administrative responsibility for discrediting the actions of the RF Armed Forces was introduced in March of this year, and Ms. Asmus’ post on social networks was posted at the end of February, when there was no such article in the Code of Administrative Offenses of the Russian Federation.
“This publication does not exist today, it is not possible to prove its existence. I texted her, she’s on set right now. I think she was delighted with this decision, ”said Christina Asmus’ lawyer (TASS quote).
Formerly Tverskoy Court of Moscow acknowledged guilty actress Tatyana Rudina under a similar article and imposed a fine of 50 thousand rubles. According to TASS, the reason for opening the case was the publication of the actress in social networks, in which she allegedly spoke negatively about the military operation. The hearings on the case were to be held on the same day, September 6. However, at the request of Mrs. Asmus’ defense, her hearing was postponed.
According to OVD-Info (included in the register of foreign agents), from March to August, 3,807 cases were filed under Article 20.3.3 of the Code of Administrative Offenses of the Russian Federation. Among the leaders in the number of cases of discrediting the army are Moscow, St. Petersburg and the Krasnodar Territory.
