The accused in the high-profile case of changing the stadium to the depot in Tula was found guilty, but released from punishment

On December 9, in Tula, after lengthy proceedings, the court delivered a verdict in the case of the exchange of the Arsenal stadium for the depot of the MCP Tulgorelektrotrans. On the dock, we recall – Tatyana Silaeva, Deputy Chairman of the Committee for Property and Land Relations of the city administration. She is charged with abuse of power, which allegedly led to losses for the ITUC in the amount of 204 million 701 thousand 667 rubles.

Announcing the last word, Tatyana Silaeva did not admit her guilt, pointing out that the charge was based solely on “the conjectures and assumptions of the preliminary investigation body, which were supported by the prosecutor.”

According to her, the exchange deal until the end of 2018 was considered as the fulfillment of the important and socially significant task set by the former governor of the Tula region to return a unique sports facility to municipal ownership, and without any monetary costs to the budget.

“The deal was considered and is considered legal by the MCP Tulgorelectrotrans and the administration of the city of Tula. Previously, it did not raise doubts and objections from the prosecutor’s office, where the permissive resolution was sent in a timely manner. To date, neither the barter transaction nor the decision of the head of the administration of the city of Tula has been disputed by anyone, ”Silaeva clarified.

The court retired to the deliberation room, and upon returning read out the verdict – and yet about the guilt of the defendant. Themis regarded the testimony of Silaeva as a desire to alleviate her plight, considered unconvincing statements by the defense that the defendant acted within her powers and by order of the head of the administration of the city of Tula.

At the same time, the court did not recognize the damage from the disposal of the depot on Oboronnaya Street from the balance of the Tulgorelectrotrans MCP – more than 112 million rubles, since the enterprise was not the owner of the facility.

Considering all the circumstances of the case, the court considered it necessary to impose a non-custodial sentence on the defendant – in the form of a fine of 50 thousand rubles, and due to the fact that the statute of limitations for this crime had already expired, Silaeva was released from serving the sentence. A written undertaking not to leave her was also removed in the courtroom.

At the same time, the court recognized the right of the state prosecution to continue the consideration of the case on compensation for damage that the enterprise suffered from making rental payments for the right to use the depot on Oboronnaya Street, only within the framework of a civil process. In this regard, it was decided to keep the arrest on the property belonging to Silaeva – residential premises and a car – pending consideration in terms of a civil claim.

The verdict in the criminal case will enter into force in 10 days – the parties have time to appeal it to the court of appeal.
