Deputy Chairman of the State Duma Pyotr Tolstoy proposed revising the principles of attracting labor migrants. In particular, the deputy advocated the abolition of the labor patent system for foreign workers.

“Abolish the system of attracting foreign labor on the basis of labor patents and replace it with the institution of “organized recruitment” on the part of the employer. This is the only way to stop the uncontrolled entry of foreign citizens into the country,” the vice speaker wrote in his Telegram channel.

A labor patent is a document that foreigners obtain to legally work in Russia. Citizens of countries with which the Russian Federation has a visa-free regime, in particular citizens of Azerbaijan, Uzbekistan, Abkhazia and Tajikistan, can apply for a patent. At the same time, citizens of Armenia, Belarus, Kazakhstan and Kyrgyzstan do not need to obtain a patent, because they are members of the EAEU.

Among Peter Tolstoy’s proposals on migration policy:

  • limit the length of stay of a low-skilled foreign worker by the validity of the employment contract. Upon expiration of the period specified in the contract, the foreigner must leave the country. The departure process must be controlled by the employer;
  • financial responsibility associated with the entry and exit of migrants from the country should be borne not by taxpayers, but by the employer;
  • low-skilled labor migrants recruited as part of organizational recruitment should not have the right to obtain a residence permit and Russian citizenship;
  • the entry into the Russian Federation of family members of migrants recruited as part of organizational recruitment should be prohibited;
  • By decision of local authorities, foreign workers recruited as part of organizational recruitment may be limited in their freedom of movement throughout the country and the territory of a federal subject.

In March the Ministry of Labor offered create a public company for the organized targeted recruitment of foreign workers and finalize the mechanism to increase the protection of employers. Targeted organizational recruitment should become a priority mechanism for labor activities carried out by foreigners. Dial operator will become State company “Work in Russia”.

According to the Ministry of Labor, if an employer terminates an employment contract with a foreigner hired for a targeted recruitment, he will be obliged to leave the Russian Federation within 30 days or enter into an agreement with a new employer. The department believes that in this way companies that have suffered financial losses while transporting a foreign employee will receive additional protection.
