Senator Andrei Klishas opposed a separate law on the activities of PMCs

Andrey Klishas, head of the Federation Council Committee on Constitutional Legislation, said that he sees no need to prepare an additional bill defining the legal status of private military companies (PMCs) in the Russian Federation. According to him, for today, an order is enough, according to which volunteer formations must conclude a contract with the Ministry of Defense.
“We are solving urgent issues in an operational mode. For example, that persons under investigation can enter into contracts only with the Ministry of Defense. I don’t consider the development of a separate law on PMCs relevant now,” said Mr. Klishas “Interfax”.
Today, Vladimir Dzhabarov, First Deputy Head of the International Committee of the Federation Council declared about the need to ban the work of PMCs inside Russia, allowing only the activities of volunteer organizations that have previously concluded contracts with the Ministry of Defense. On June 25, the head of the State Duma Committee on Defense Andrei Kartapolov spoke about the work on the draft law regulating the activities of PMCs in Russia. The statements were made against the backdrop of an armed rebellion by PMC Wagner on June 24.
According to Article 13, part 5 of the Constitution, the creation of armed formations is prohibited in Russia. Article 208 of the Criminal Code of the Russian Federation provides for punishment of up to 20 years in prison for organizing such formations, a similar punishment is provided for under Article 359 – mercenarism. The need to regulate the activities of private military companies has repeatedly drawn the attention of Russian deputies. The government pointed out that the bill contradicts Part 5 of Art. 13 of the Constitution (prohibition of the activities of organizations aimed at shifting the constitutional order of Russia).
